My brother, Joshua Saeta, is 49 years old and depends entirely on others for his care. I am his sister, Jennifer, and I am fighting to protect Joshua’s life.
Joshua is conscious. He smiles, laughs, blinks on command and responds to the people he knows. Yet end-of-life decisions about Joshua are being discussed right now under Ventura County Probate Court oversight, and his IV nutrition infusion rate has already been cut from 100 mL an hour to 75 mL an hour. I fear that decisions to sedate him and stop his nutrition could be carried out before I have a chance to intervene or am told what is happening.
Joshua cannot wait. Please help me stop this before it is too late.
JOSHUA IS NOT IN A VEGETATIVE STATE
I was Joshua’s essential caregiver for eight and a half years, including five and a half years of care at home. Twice, seven months apart, the court has been told that Joshua is in a “vegetative state.” That is not true. I have watched Joshua smile, laugh, vocalize, blink and move his feet on command, and respond to people he knows. Videos capture these responses, and others have witnessed them. Yet Joshua has never been brought to a single hearing, not even by Zoom. No one should make life-and-death decisions about Joshua without ever seeing him. I am demanding that this evidence be examined.
JOSHUA’S IV NUTRITION INFUSION RATE HAS BEEN CUT
Joshua is allowed nothing by mouth, and his J-tube is not being used for feeding, even though hospital physicians told me Joshua should receive nutrition through that tube. That leaves an IV as Joshua’s only nutrition. He is on total parenteral nutrition (nutrition delivered through an IV), and his infusion rate was cut from 100 mL an hour to 75 mL an hour. I am demanding an immediate review of what nutrition Joshua is actually receiving and whether it meets his needs.
THE LAW PROTECTS JOSHUA
In Conservatorship of Wendland (2001), the California Supreme Court required clear and convincing evidence before a conservator may withhold artificial nutrition and hydration from a conscious conservatee who is not terminally ill, comatose or in a persistent vegetative state, and who left no formal health-care instructions or appointed decision-maker. The evidence must show that withholding it would follow the patient’s own wishes or serve his best interests. I am seeking these protections for Joshua.
I am demanding that Joshua’s condition be assessed directly, that his physicians be heard on the record, and that the court enforce the protections governing his life-sustaining care.
Joshua has the right to live. His disability does not erase his humanity. If you are a lawyer, a physician, a journalist or a public official, or you know one, please help me reach someone who can intervene before it is too late.
